Consumer Rights – Withdrawal – Cancellation and Return Conditions

GENERAL:

  1. When you place an order electronically via the website you are using, you are deemed to have accepted the preliminary information form and the distance sales agreement presented to you.

  2. Buyers are subject to the provisions of the Consumer Protection Law No. 6502 and the Distance Contracts Regulation (OG: 27.11.2014/29188) as well as other applicable laws concerning the sale and delivery of purchased products.

  3. Buyers are responsible for paying the shipping costs of product deliveries.

  4. Each purchased product will be delivered to the person and/or organization at the address indicated by the buyer within a maximum period of 30 days. If the product is not delivered within this period, buyers may terminate the contract.

  5. The purchased product must be delivered complete and in accordance with the specifications stated in the order, along with any relevant documents such as a warranty certificate or user manual, if applicable.

  6. If it becomes impossible to sell the purchased product, the seller must notify the buyer in writing within 3 days of learning this fact. The total amount must also be refunded to the buyer within 14 days.

IF THE PURCHASE PRICE IS NOT PAID FOR THE PRODUCT:

  1. If the buyer does not pay for the purchased product or cancels the payment in the bank records, the seller’s obligation to deliver the product ends.

UNAUTHORIZED USE OF A CREDIT CARD:

  1. After the product has been delivered, if it is determined that the payment was made with a credit card used by unauthorized persons, and the bank or financial institution does not pay the product price to the seller, the buyer must return the product to the seller within 3 days, with shipping costs borne by the seller.

UNFORESEEN CIRCUMSTANCES PREVENT PRODUCT DELIVERY:

  1. In the event of unforeseen circumstances that the seller cannot foresee and which prevent the delivery of the product within the specified time, the buyer will be informed. The buyer may request the cancellation of the order, replacement of the product with a similar one, or postponement of delivery until the obstacle is resolved. If the buyer cancels the order, the payment will be refunded in cash if paid in cash within 14 days of cancellation. If paid by credit card, the product amount will be refunded to the bank within 14 days of cancellation, but the bank may take 2-3 weeks to transfer the refund to the buyer’s account.

BUYER'S OBLIGATION TO INSPECT THE PRODUCT:

  1. The buyer is responsible for inspecting the goods/services subject to the contract before receiving them. The buyer should not accept damaged or defective goods/services (such as crushed, broken, or torn packaging) from the shipping company. Goods/services that are accepted are deemed to be undamaged and in good condition. After delivery, the buyer must carefully protect the goods/services. If the right of withdrawal is to be exercised, the goods/services must not be used. The product and its invoice must also be returned.

RIGHT OF WITHDRAWAL:

  1. The buyer may exercise the right of withdrawal by rejecting the goods within 14 days from the date of delivery to themselves or the person/organization at the address indicated, without assuming any legal or criminal liability and without providing any justification. This must be communicated to the seller using the contact details provided below.

DURATION OF THE RIGHT OF WITHDRAWAL:

  1. If the purchased product is a service, the 14-day withdrawal period begins on the date the contract is signed. The right of withdrawal cannot be exercised for service contracts that have begun execution with the consumer’s approval before the end of the withdrawal period. Buyers acknowledge that they are aware of the withdrawal terms before placing their orders.

  2. The costs arising from the exercise of the right of withdrawal will be borne by the seller.

  3. To exercise the right of withdrawal, a written notification must be made to the seller via registered mail, fax, email, or another method specified by the seller within the 14-day period. The product must also remain unused and comply with the provisions on "Products That Cannot Be Returned."

    USE OF THE RIGHT OF WITHDRAWAL:

    1. The invoice for the product delivered to the third party or the buyer must be returned. If the invoice for the product to be returned is issued to a legal entity, it must be sent back with the return invoice issued by the institution. Returns of orders invoiced to institutions cannot be completed without a return invoice.

    2. The return form, the box, packaging, and any standard accessories of the returned products must be delivered completely and undamaged.

    RETURN CONDITIONS:

    1. The seller is obligated to refund the total amount and any documents obligating the buyer within 10 days of receiving the withdrawal notification. The seller is also required to retrieve the product within 20 days.

    2. If the product’s value decreases due to the buyer's fault or if the return becomes impossible, the buyer is responsible for compensating the seller’s damages proportionally to their fault. However, the buyer is not responsible for changes or deterioration that occur due to the proper use of the product within the withdrawal period.

    3. If the right of withdrawal is exercised and the campaign limit amount is reduced due to the return, the discount amount used in the campaign will be canceled.

    PRODUCTS THAT CANNOT BE RETURNED UNDER THE RIGHT OF WITHDRAWAL:

    1. Products prepared in line with the buyer's request or clearly personalized needs, products that are not suitable for return, such as underwear, swimwear, makeup products, perishable goods, or items with an expiration date, and products that are not suitable for return due to health and hygiene reasons if their packaging has been opened after delivery, cannot be returned. This also includes products that have been mixed with other items after delivery and cannot be separated by their nature.

    2. Cosmetic and personal care products, underwear, swimwear, books, software, and programs that can be copied, as well as DVDs, VCDs, CDs, and stationery supplies (e.g., toner, cartridges), can only be returned if their packaging is unopened, unused, undamaged, and intact.

    3. According to the Distance Contracts Regulation, the following contracts do not allow for withdrawal:

    • Contracts for goods prepared according to the consumer’s wishes or personal needs,
    • Contracts for goods that may perish quickly or whose expiration date may expire,
    • Contracts for goods whose packaging, tape, seal, or protective elements have been opened after delivery and are therefore unsuitable for return due to health and hygiene reasons,
    • Contracts for goods mixed with other products and which cannot be separated by their nature after delivery,
    • Contracts for the supply of periodicals such as newspapers and magazines, except for subscription agreements,
    • Contracts for services provided instantly in electronic environments or for intangible goods delivered instantly to the consumer.

    DEFAULT AND LEGAL CONSEQUENCES:

    1. If the buyer defaults on payment via credit card, they agree to pay interest under their agreement with the credit card issuer bank and to accept responsibility toward the bank. In this case, the bank may pursue legal action and claim legal fees and attorney’s fees from the buyer. The buyer agrees to compensate the seller for damages caused by delayed payment.

    PAYMENT AND DELIVERY:
